terms of service

these terms govern your use of emptywords.co (the “site”) and our Telegram training bot (the “bot”, and together with the site, the “service”) operated by Empty Words LLC (“we”, “us”, “our”). by creating an account, using the site, or messaging the bot, you agree to these terms and to our privacy policy, including the collection and use of the messages you exchange with the bot for the purposes described there. if you do not agree, do not use the service.

1. the service

the site provides written content, training exercises, companion Telegram access, and related materials (the “content”) on a subscription basis. paid content requires an account and an active paid subscription.

to operate the bot, we may first send relevant conversation content to Anthropic through a locally authenticated Claude subscription session. when that path is unavailable, we send relevant conversation content to the OpenAI API for reply generation. we also send voice-note audio to the OpenAI API for transcription, as described in the privacy policy. do not use the bot if you do not agree to this processing.

2. accounts

you must be at least 18 years old to use the site. by creating an account, you represent that you are 18 or older. we do not knowingly provide access to anyone under 18.

you must create an account to access paid content. you are responsible for keeping your credentials secure. one account per person. we may refuse new access at our discretion. to the extent permitted by applicable law, we may suspend, restrict, or remove an account at our discretion, with or without cause or advance notice. if we remove a paid account, we will cancel its subscription so it does not renew. removal does not erase transaction, consent, security, tax, fraud prevention, dispute, or other records that we are permitted or required to retain under applicable law and our privacy policy.

an account may be created from the website or when a Telegram user deliberately asks the bot to open Stripe Checkout. creating an account does not itself create a subscription or charge you.

3. subscriptions and payment

the paid product is Empty Words Private with companion Telegram access. it costs $9 USD per month, plus applicable taxes, and is billed through Stripe until cancelled. the bot’s free taste does not start a trial, create a paid subscription, automatically convert, or charge you. payment begins only after you deliberately open and complete Stripe Checkout and accept the recurring-billing terms shown there.

Free opens one conversation in any rolling seven days. Each Free conversation ends after 20 minutes or 12 messages from you, whichever comes first. Private stays open while access is active. No message cap.

automatic renewal disclosure. your $9 monthly Stripe subscription, plus applicable taxes, automatically renews at the end of each billing period unless you cancel before the renewal date. to cancel, open the website, sign in with Telegram if prompted, and choose manage subscription on the private or profile page. you may also contact hello@emptywords.co for billing support. when you cancel your own subscription and your account remains active, cancellation stops the next renewal and access ordinarily continues through the paid period. this ordinary cancellation rule does not limit the suspension, restriction, or termination rights in section 6. this disclosure is provided in accordance with applicable automatic renewal laws.

if you are a California resident, you are entitled to the above notice of automatic renewal terms before you are charged. you may cancel at any time as described above.

we may change pricing with 30 days notice. continued use after a price change constitutes acceptance.

refund policy. all subscription fees and one time digital content charges are final. Empty Words does not provide discretionary refunds, credits, or prorated refunds for partial billing periods, unused access, cancellation, dissatisfaction, or any other reason. cancellation stops future renewals and does not refund the current paid period. this does not limit any refund, reversal, withdrawal right, or other remedy required by applicable law. Stripe and card network dispute procedures remain available where applicable. for payment questions, email hello@emptywords.co.

optional document purchase. after all included Private document choices have been used, a current Private subscriber may choose one additional document for a one time charge of $49 USD, plus applicable taxes. this purchase opens only the document selected through that Checkout. it does not include, extend, or replace Private access. current Private access is required to read the document. if Private access ends, the selection remains attached to the account and becomes readable again if Private access returns. except where required by law, the charge is not refundable after access is delivered. a full refund, payment reversal, or active or lost dispute closes access tied to that charge. access may return if Stripe confirms that a dispute was won, or an inquiry closed without loss, and the funds remain captured.

digital content delivery. by subscribing, you request immediate access to digital content. if you are in the European Economic Area, you acknowledge that you have requested immediate delivery of digital content and that you thereby waive your 14-day right of withdrawal under applicable EU consumer law once access is granted.

free trials. if we offer a free trial, it will convert to a paid subscription automatically at the end of the trial period unless you cancel before the trial ends. only one free trial per person. we reserve the right to revoke trial access at our discretion.

4. intellectual property

all content on the site is owned by Empty Words LLC or its licensors. you may not copy, redistribute, republish, sell, or create derivative works from any content without written permission.

your account grants you a personal, non-transferable, non-exclusive license to access the content for your own use during your active subscription.

5. acceptable use

you agree not to:

  • share your account credentials with others
  • scrape, crawl, or programmatically access the site
  • attempt to circumvent access controls or payment requirements
  • use the content for commercial purposes without written permission
  • interfere with the site’s operation

6. termination

to the extent permitted by applicable law, we may immediately suspend, restrict, or terminate any account at our discretion, with or without cause or advance notice. termination may end access immediately. if the account has a paid subscription, we will cancel future renewal. fees already paid are not refunded or credited merely because access is suspended or terminated, except where applicable law requires a refund, credit, reversal, withdrawal right, or other remedy.

termination does not require us to erase transaction, consent, security, tax, fraud prevention, dispute, or other records that we are permitted or required to retain under applicable law and our privacy policy. provisions that by their nature should survive termination remain in effect.

7. disclaimer of warranties

the site and content are provided “as is” without warranties of any kind, express or implied. we do not guarantee the content will meet your expectations, be uninterrupted, or be error-free.

the content is informational and educational. it is not professional advice. you assume all risk from your use of or reliance on the content.

8. limitation of liability

to the maximum extent permitted by law, Empty Words LLC and its members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or content.

our total liability for any claim arising from or related to these terms shall not exceed the amount you paid us in the twelve months preceding the claim.

9. indemnification

you agree to indemnify, defend, and hold harmless Empty Words LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the site or content; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) any content or materials you submit to the site.

10. dispute resolution and arbitration

please read this section carefully. it affects your legal rights.

any dispute, claim, or controversy arising from or related to these terms or your use of the site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. the arbitration shall be conducted in Cook County, Illinois, or by telephone or video at your election.

class action waiver. you and Empty Words LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. the arbitrator may not consolidate more than one person’s claims.

jury trial waiver. you and Empty Words LLC waive any right to a jury trial for any dispute covered by this section.

you may opt out of this arbitration agreement by sending written notice to hello@emptywords.co within 30 days of first creating your account. opting out does not affect any other provision of these terms.

nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

any claim arising from or related to these terms must be filed within one year after the relevant claim arose. claims filed after this period are permanently barred.

11. governing law

these terms are governed by the laws of the State of Illinois, United States. any dispute not subject to arbitration shall be resolved in the courts of Cook County, Illinois.

the site may contain links to third-party websites or resources. we provide these links for convenience only. we do not control, endorse, or assume responsibility for the content, products, services, or practices of any third-party site. accessing third-party sites is at your own risk and subject to their terms and policies.

we respect intellectual property rights. if you believe content on the site infringes your copyright, send a written notice to our designated agent at hello@emptywords.co including: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location on the site; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner. we will respond to valid notices in accordance with the Digital Millennium Copyright Act.

14. force majeure

we are not liable for any failure or delay in providing the site resulting from events beyond our reasonable control, including but not limited to acts of god, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, hosting or third-party service interruptions, or technical malfunctions. we do not guarantee uninterrupted or continuous availability of the site.

15. severability

if any provision of these terms is found to be unlawful, void, or unenforceable, that provision is severable from these terms and does not affect the validity and enforceability of the remaining provisions. the unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.

16. entire agreement

these terms, together with the privacy policy, constitute the entire agreement between you and Empty Words LLC regarding your use of the site and supersede all prior or contemporaneous understandings, agreements, representations, and communications, whether written or oral. our failure to enforce any provision is not a waiver of that provision.

17. changes

we may update these terms at any time. continued use of the site after changes constitutes acceptance. material changes will be posted on this page with an updated date.
